These terms and conditions apply to users of Gyan Money app and website. By using our website and application users indicate their acceptance of these terms.

Background

(i) Gyan Money is a live quiz gaming application. By playing quizzes in this application, it helps in boosting general knowledge and IQ level of people from all age group.

(ii) App enables registered Site users to join contests by paying a specific entry fee. User can know about the upcoming contests by opening the application. Upcoming contests are displayed on application home screen with a pre-defined time of Contest.

1. Acceptance

1.1   By accessing our Gyan Money application and website, you acknowledge and accept that:

(i) you have read, fully understood and accepted these Terms and Conditions; and

(ii) these Terms and Conditions constitute a legally binding agreement between the you and us regarding the use of the services offered by us.

1.2 The Site Terms apply to all visitors and users of the App/Site. If you do not agree with any of the terms of these Terms and Conditions, please do not attempt to use or continue using any of the Services or use the Website.

2. Modification,

2.1   We hold the right to amend, update and modify these Terms and Conditions. Please ensure that you regularly check these Terms and Conditions for modifications which may be made from time to time.

2.2   You acknowledge and agree that it is your sole responsibility to check for any such amendments, updates and/or modifications. We will endeavour to notify you of significant updates and modifications.

Language.

2.3. If you are reading a translation of any Site Terms (including any Terms concerning bonuses) in a language other than English, you acknowledge and agree that

(i) the English version is the official version and is the legal basis of the relationship between you and Gyan Money APP.;

(ii) the non-English versions reflect the same principles as the English version however they are only provided for information purposes and you for your convenience;

(iii) the non-English versions are not valid as an agreement between you and us.; and

(iv) in the event of any inconsistency between the English and a non-English version of any Site Terms, the English version will prevail and govern.

 

3. Ability to Accept Terms and Legality of Use.

3.1. The App/Site do not restrict individuals under the age of eighteen (18). Therefore, whether if you are under 18 year, or above 18, you are not prohibited from registering an Account (defined below) and using the Services (defined below).

3.2. It is your responsibility to determine that your access and use of the Site and the Services is legal and permissible under all applicable laws and regulations.

 

4. App/Site Access and Use.

4.1   As a condition of use of our Site and application, you warrant and undertake that you shall not use or access the Website or application for any purpose that is unlawful under any law that is applicable to you or that is prohibited by and/or in breach of these Terms and Conditions.

4.2   You warrant, accept and undertake as a condition of use of the website or application:

(i)  that you are playing quiz on your own behalf;

(ii)  that you are not restricted by limited legal capacity;

 (iii) that you are fully aware of the risk of losing money (Contest Entry Fee) in the course of joining the contest on our Mobile App;

(iv)  that you are not conducting criminal or otherwise unlawful or unauthorised activities and/or intending to use your account opened with us in connection with such activities and that you shall not use or allow other persons to use the Website and your account for any criminal or otherwise unlawful activities including, without limitation, money laundering, under any law applicable to you or us;

 

(v)  to keep your account details secure, confidential and protected against unauthorised access or use and to ensure to you should notify us immediately if the confidentiality of your account has been compromised in any way;

(vi)  to be solely responsible for any and all activities that occur under the access to and use of the Services on and through the Website(s) and/or Device(s) under your account regardless of whether such access and/or use was authorised by or known to you or not;

(ix)  not to use the Services/Website in any way which interferes or may interfere with the availability of the Services/Website to other users nor do anything that degrades or may degrade the operational performance of the Services and Website(s);

(x)  not to solicit or in any manner seek to obtain any information relating to other users;

(xi)  not to upload or distribute any program, file or data that contain viruses, are corrupted or may affect the operational performance of the Application/Website;

(xii)  that your access to or use of the Information on and through the Website & App is not illegal or prohibited by laws that are applicable to you or contractual obligations which apply to you personally or to persons in the city from which you are currently accessing the Website/quiz application;

(xiii)  not to use any device, robot, spider, software, routine or other method (or anything in the nature of the foregoing) to interfere or attempt to interfere with the proper functioning of the Service;

(xiv)  not to post or transmit to the Website or to any other users, any unlawful, harassing, abusive, threatening, libellous, defamatory, obscene, indecent, inflammatory, racially or ethnically objectionable, pornographic or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.

5.Account.

5.1. General, In order to use some of the Services, it is necessary to first create an account (an “Account”) and submit certain mandatory information to us in connection with your Account. You reserve the right to decide whether to submit any information to us, however, if you choose not to submit mandatory information you may be unable to register an Account and use and participate in certain Services. You may only register one Account for your personal use. You agree not to create an Account for anyone else or use the Account of another. When creating your Account, you must provide accurate and complete information, including full name, confirmation of legal age (if necessary as per the norms applicable by the government), contact e-mail or personal telephone number, and must thereafter keep such details up-to-date. Gyan Money will store such details in accordance with the Data Protection Act (Acc. To the Laws) and the regulations issued thereunder as may be amended from time to time. By providing these data you grant Gyan Money permission to verify the data provided, including the verification of your age, directly through Gyan Money through specialized third-party providers. You are solely responsible for the activity that occurs in your Account, and you must keep your Account password secure. Gyan Money will treat with care the information you entrust to it, in accordance with its privacy policy. You must notify Gyan Money immediately of any breach of security or unauthorized use of your Account. You can stop using and may delete, your Account at any time by using the tools that are available on the App/Site (“App/Site Tools”). It is prohibited for users to sell, transfer and/or acquire Accounts to or from other Users or to transfer funds between Accounts.

5.2. Account Restrictions. If you are an (1) employee, director, officer, or Agent (defined below) of the Gyan Money Group or (ii) entity or person that is connected with the management or operation of an Gyan Money Group, including each Gyan Money Operator and its employees; or (iii) a spouse, de facto partner, parent, sibling, child or close family member of any of the persons mentioned in (i) and (ii) above, or (iv) located in the India which prohibits the provision of services such as the Services, then you are prohibited from registering an Account and participating in any Services. “Agent” means any third-party service provider (and its employees) that we engage to perform Site management tasks on our behalf.

5.3. We reserve the right to refuse to create an account or to close an Account, at our sole discretion, save only that in the event of the closure of an Account, we will honour any already existing obligations we may have to the User thereof

5.4. You may close your Account at any time by writing to us at ()(PLEASE NOTE THAT WE WILL TAKE THE NECESSARY ACTIONS ONLY AFTER DUE VERIFICATION OF YOUR REQUEST)

5.5. We shall notify you by means of an email sent to the email address listed in your Account (such notice will be entitled, “Inactive Account Notification”) that your Account is about to become an Inactive Account. The Inactive Account Notification will be sent to you up to one month prior to your account becoming inactive.

 

5.6. If your Account is considered a DORMANT ACCOUNT, i.e. no transaction has been recorded on the Account for a period of six (06) months or longer, we will notify you by means of an email to the email address listed in your Account (such notice will be entitled, “Dormant Account Notification”).

5.7. If you do not take any action on your Account or contact us within seven (7) days of such email notification, all funds therein will be removed from your Account and either (1) transferred to you or, (ii) if we have been unable to contact you and/or if you cannot be satisfactorily located, transferred to the Authority.

5.8. Following the transfer of funds as described we shall close your Account.

 

6. Quiz Contest.

Each quiz is performed by the Gyan Money. Your participation in each quiz game is subject to the terms and conditions of the related Gyan Money. (“Gyan Money Operator Rules”), which you agree to independently review and comply with.

 

 

7. The Quiz and Win Service.

7.1. General. We (i) make certain tools available on the App/Site so that Users can complete and submit online.

7.2. Participation in the game.

 In order to participate in the game, you must:

 (i) have registered a valid, and maintain an active, Account; and (ii) comply with these Terms, a user satisfying these terms and lawfully joining Gyan Money quizzes by paying a specific entry fee.

7.3. Cut-off Time. We stop to accept the submission of quiz joins a certain number of minutes before the quiz gets started by Gyan Money Operator (“Cut-Off Time”). We display on the App/Site the amount of time that is remaining until the Cut Off Time for each quiz contest on the App/Site. We retain the right in our sole discretion to determine the length of the Cut-Off Time. Please be aware that once the Cut-Off Time for a particular Skill has expired, you will no longer be able to join that quiz.

7.4. Be ready for playing quiz contest on the specific time (Display in the contact details), however our app send notification before 05 minutes starting the contest. It is your responsibility to join the contest on time, if you not join contest on time than entry fee will not refunded to you.

7.5. TDS and Transfer Charges.

You acknowledge and agree that

 (i) Tax Deduction at Source or TDS will be done as per existing Government IT Laws when your redeem/withdrawal amount is more than Rs. 9990 (ii) Bank transfer charges or admin charge may also apply @ 5%.

 

8. Performance of Right Answer and Results.

8.1. Following each quiz contest Gyan Money will declare the result of each quiz within the 10 minutes after quiz gets over. The results for single quiz will be shown right after the quiz gets over. And Leaderboard & All results will be declared after 10 minutes.

8.2. Contest Result Conditions/Process: Candidates will need to score more in less time to qualify for winning. Our Result Process will be transparent. We will provide Question & correct Ans after the result publish. You accept that the results given from our end will be final and unobjectionable. However, in case of other queries, you can write to us at (support@gyanmoney.com) or can submit your query through feedback form. Please note that there will be both written communication via email or through direct call from Gyan Money support.

 

9. The Subscription Service.

9.1. General. The App/Site enables you to automatically participate in our contest Services, in a specific Gyan Money or a specific Category periodically (the “Subscription Service”).

9.2. You may choose to simultaneously join an unlimited number of quizzes only in a given set of time.

9.3. Term of Participation. You agree that your subscription (if applicable), and related payment. obligations, will remain active until you use the App/Site Tools to suspend or deactivate your participation in the Subscription Service (if applicable), which you may do at any time (you may also use the Site Tools to reactivate your participation in the Subscription Service).

 

10. Payments.

10.1 (a) For such time as you are participating in the Gyan Money quizzes you will be charged from the funds you add in your wallet for each match that you play.

(b) We Endeavour to join on the user’s behalf each Gyan Money quizzes as soon as the App/Site begins to accept quiz joining and therefore you acknowledge that clicking on the “JOIN NOW” button will be considered your acceptance to deduct the Contest Entry Fee from your Gyan Money Wallet. In case you decide to suspend or deactivate your participation in the contest afterwards, you accept that there will be no refund provided for the amount you have paid for the quiz contest.

(c) PLEASE NOTE THAT YOU CAN SUBMIT THE RESPONSE TO EACH QUESTION ONLY ONCE, ONCE YOU HAVE SKIP THE QUESTION YOU CANNOT GO BACK ON THAT QUESTION AND BEFORE THE CLOSE TIME OF THE RESPECTIVE CONTEST.

10.2. You accept that the minimum joining amount is Rs.25 and the recharged amount cannot be withdrawn once added.

 

11. Alert Service.

General. We offer certain alert services in connection with the App/Site whereby we provide Users with the opportunity to receive updates and alerts about Gyan Money, and the results of quizzes played. The Alert Service may provide Users with the opportunity to choose whether to receive certain notifications by on Gyan Money app. User must remind that alert will be shown only for the quizzes joined.

 

12. Valid Email Address and Mobile Phone Number.

In order to use the Alert Service of Gyan Money App you must

• have downloaded Gyan Money app on your device and maintain an active Account; (ii) comply with these Terms, and
• you have to create your account by your valid e-mail ID & Mobile No.
• alerts / notification will be received only when you have joined quizzes.

 

13. Aborted Orders and Termination Orders; Errors.

13.1. In the event that the processing of joining, once it has been Placed, is interrupted by a system failure of any nature and is not capable of completion, the amount of the joining the quiz contest will be refunded to your account.

13.2. We reserve the right to terminate the joining for a quiz contest without prior notice, whenever we deem this necessary due to software or other errors,

13.3. In the event that any information is incorrectly published on the App/Site, we will take action in order to rectify and amend the data in our system to reflect the correct information. Any winnings which are affected by the publishing of incorrect information will also be accordingly amended.

 

14. Payments by You to Gyan Money; Deposits.

14.1. Quiz Joining.

You acknowledge and agree that if

 (i) you choose to make a transaction on the App/Site (for example, by paying for joining a quiz) with your credit card; or (ii) there are insufficient funds in your Account to pay for a transaction that you have entered into, then Gyan Money may charge that credit card or the credit card that you designate in your Account, and you hereby authorize the charging of that credit card (or any replacement card).

14.2. Restrictions and Acknowledgements.

You agree:

(i) to only provide valid and current debit card or other online payment and billing information for yourself;

(ii) that we may use the tools, software or services of third-party service providers to process transactions on our behalf;

(iii) that you shall be liable for any card issuer processing fees in connection with payments and recurring payments;

 (iv) except as expressly set forth herein, all purchases are final and non-cancellable or non-refundable; (v) if payment is not received by us for any reason from your card issuer, you agree to promptly pay all amounts due to us upon demand and, if applicable Gyan Money may charge a reasonable rejected payment fee, and (vi) any failure or inability by Gyan Money to process any payment hereunder does not relieve you from your payment obligations.

14.3. In order to deposit funds in your Account, you can utilize one of the available deposit methods. Information on the methods available for deposits, including deposit limits, processing times can be found in the Banking section of the App/Site As soon as you have registered your account, you can carry out an online deposit by clicking the “ADD” button and following the directions, Gyan Money does not charge you a handling fee when you make a deposit.

14.4. We reserve the right to impose certain conditions on the use of particular payment methods and to change the payment methods available without giving notice. We do not guarantee that all methods of payment are available at all times.

14.5. We reserve the right to use additional procedures and means to verify your identity and carry out a “Know Your Client” (“KYC”) procedure when you deposit funds in your Account.

14.6. The minimum recharge amount is Rs.25 and further it depends on the entry fee of the contest.

 

15. Refund Policy.

15.1. Except as expressly stated in these Terms, you acknowledge and agree that any joining prices and fees and/or payments paid by you to Gyan Money in connection with your use of the App/Site and any Services are non-refundable.

15.2. If you reasonably believe that you have been wrongfully charged an amount by us you may notify us and request a refund. If we, in our sole discretion, find that an amount has been wrongfully charged we will, as your sole remedy, refund you that amount.

 

16. The Transfer of Amounts to You and Your Use of Such Amounts.

16.1. General. During your use of the App/Site and Services, the following types of money or credit may be transferred to you or your Account:

(i) Prizes;

(ii) the cash value of money that you deposit into your Account for your use on the App/Site (“Deposits”); and/or

16.2. Use of Real Money. Real Money is transferred to your Account and may be used in connection with your future transactions on the App/Site (for example Place Orders). You may withdraw any unused Real Money at any time.

16.3. Use of Referral Money. You will earn referral money when the user you refer successfully downloads, registers on the app & Joined Contest Successfully.

16.4. Withdrawals from your Account.

You may use the App/Site Tools to withdraw the available Real Money in your Account during redeemed your Gyan Money Wallet Amount, or any part thereof, by selecting your preferred withdrawal method. In order to withdraw certain amounts, you may first be required to provide us with specific information that will be used to confirm your identification and/or verify your credit card/post-paid instruments or another payment method third-party. You need to provide your KYC (ADHAAR CARD and BANK DETAILS).

 Additional information regarding the withdrawal of Real Money is displayed on the App/Site. Withdrawals will be remitted to the same account from where the funds paid into the User’s Account originated, except in exceptional instances. To the extent that any User wishes to withdraw funds from a dormant, blocked, closed or excluded Account, they should contact the help desk. You agree that withdrawal can only be made in multiples of 10 and the minimum withdrawal limit is Rs.200.

16.5. Restrictions on Withdrawals from your Account.

At least one game must be played before you are permitted to withdraw funds that you deposited in your account, but have not been used for playing.

16.6. For the avoidance of doubt, Gyan Money is not, nor should be treated as a financial institution. No interest will be paid on any amounts deposited with or otherwise held by Gyan Money

16.7. The personal data of a User’s Account and of the holder of the bank account (or any other payment method) to which it is requested that any Withdrawal be paid must correspond. We may perform a KYC procedure through which we will verify the validity of a User’s personal details submitted prior to permitting any Withdrawal.

16.8. Information on withdrawal methods including settlement times and applicable fees can be found in the Banking section of the App/Site.

16.9. Taxes and Reporting. You shall be solely and wholly responsible for the reporting and payment of any and all taxes and charges arising from or imposed on amounts paid or transferred to you by the App/Site under these Terms. You acknowledge and agree that the Gyan Money might retain a portion of your Prize and forward it to the appropriate taxing authority on your behalf.

 

17. Intellectual Property Rights.

The content on the App/Site, including without limitation, the text, documents, descriptions, products, technology, software, graphics, photos, sounds, videos, interactive features, and services (collectively, the “Content”) and the trademarks, service marks and logos contained therein (“Marks”), are the property of Gyan Money and/or its licensors and may be protected by applicable copyright, trademark, patent or other intellectual property laws and treaties. We reserve all rights not expressly granted in and to the App/Site and the Content. Content on the App/Site is provided to you “AS IS” for your information and personal use only and may not be used, modified, copied, distributed, transmitted, broadcast, displayed, sold, licensed, de-compiled, or otherwise exploited for any other purposes whatsoever without our prior written consent. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. Gyan Money and other marks are Marks of the Gyan Money or its affiliates. All other trademarks, service marks, and logos used on the App/Site are the trademarks, service marks, or logos of their respective owners.

 

18. Disclosure.

We reserve the right to access, read, preserve, and disclose any information that we obtain in connection with the App/Site, and your use thereof, as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process, subpoena or governmental request, (ii) enforce the App/Site Terms, including to investigate potential violations of them, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Gyan Money its users or the public.

 

19. Information Description.

We attempt to be as accurate as possible. However, we cannot and do not warrant that the Content available on the App/Site is accurate, complete, reliable, current, or error-free. We reserve the right to make changes in or to the Content, or any part thereof, in our sole judgment, without the requirement of giving any notice prior to or after making such changes to the Content. Your use of the Content, or any part thereof, is made solely at your own risk and responsibility.

 

20. Privacy.

You agree that any of your personal information that we may collect or obtain in connection with the App/Site and Services shall be subject to, and may be used in accordance with, our privacy policy which is available in Gyan Money (“Privacy Policy”). Only employees of Gyan Money who require such access to perform their tasks will have access to such information. Save as set out in this point above, we will only supply your personal information to third parties on an opt-in basis (i.e., you must authorize us to do so).

21. Support Service, Questions, and Complaints.

21.1. If you have any questions or complaints regarding the App/Site, including with respect to our Services and/or any payments, you may

(i) email us at(support@gyanmoney.com),

(ii) submit an inquiry to us by using ‘Contact Us’ or in option that is provided on the App/Site;

 (iii) chat with us via the online tool that we provide on the App/Site; and/or

(iv) call us (at your own cost) to the support telephone number that we display on the App/Site (collectively, the “Support Service”). We use commercially reasonable efforts to respond as quickly as possible. If you have a complaint, you agree to provide full details of your complaint so that we can clearly identify the issue of concern. We may use the tools, software or services of third-party service providers in connection with the Support Service.

21.2. A complaint must contain clear information regarding the complainant’s identity and must include all relevant details which gave rise to the complaint.

21.3. Should you not be satisfied with the way your complaint was resolved or handled you may escalate directly to the Authority by sending an email.

21.4. We will inform you, or the Authority, if the complaint was referred to us by the Authority, by notice in writing, of the results of our inquiry within 21 days from the date on which the complaint was submitted to us.

 

22. Indemnity.

You agree to defend, indemnify and hold harmless Gyan Money and our affiliates, and our respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney’s fees) arising from (i) your use of, or inability to use, the App/Site; (ii) any dispute between you and another; or (iii) your violation of the App/Site Terms.

 

23. Responsible Gyan Money Gaming Policy.

Gyan Money encourages a responsible attitude towards knowledge and in this regard, we:

 (i)Do not prohibit anyone under the age of 18 years from registering an Account and joining our quizzes

(ii) recommend that all Users establish limits for participating in Gyan Money ; and

(iii) do not recommend that Users turn to play quiz contest as a source of income or as a way to recoup the debt. If you feel that you are using our Services in an irresponsible way we encourage you to stop using and close your Account by using the App/Site Tools that we make available on the App/Site to do so.

These include the following:

Gyan Money

1. You may, at your discretion, choose to limit the amount you may deposit during a specific period as is provided using the App/Site. b. You may, at your discretion, choose to limit the amount you may spend during a specific period as is provided using the App/Site. c. If you wish to reduce a limit or increase an exclusion, these shall become effective immediately upon receipt of notification. If you would wish to increase a limit set by you, such change shall only take place after the request has been received. The time out and self-exclusion are irrevocable for the selected period.

 

24. Term and Termination.

These Terms are effective until terminated by Gyan Money. Gyan Money, in its sole discretion, has the right to terminate your access to the App/Site, or any part thereof, immediately at any time (including, without any limitation, for a breach of the App/Site Terms). Gyan Money shall not be liable to you or any third party for termination of the App/Site, or any part thereof. If you object to any term or condition of the App/Site Terms, or any subsequent modifications thereto, or become dissatisfied with the App/Site in any way, your only recourse is to immediately discontinue use of the App/Site. Upon termination of these Terms, you shall cease all use of the App/Site), and any provision which by its nature should survive shall survive termination of these Terms.

25. Assignment.

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by Gyan Money without restriction or notification to you.

 

 

26. Mediation and Disputes.

26.1. General. Any claim or dispute arising out of or relating to these Terms and/or your use of the App/Site may be submitted for mediation before the Authority, which can be contacted at the support desk. If such claim or dispute is not resolved by such mediation, it shall be resolved exclusively by arbitration conducted in law, in the English language by a sole arbitrator (“Arbitrator”) appointed by the parties or in the absence of agreement by Gyan Money. You and Gyan money agree to law as the exclusive forum for resolving any claim or dispute arising out of or related to these Terms and/or your use of the App/Site the Arbitrator will be bound by the provisions of these Terms. Upon rendering a decision, the Arbitrator shall state in writing the basis for the decision, and the written decision of the Arbitrator shall be binding on the parties to the arbitration. Any judgment upon the reward may be entered and enforced in any court of competent jurisdiction. Notwithstanding the foregoing of Gyan Money may seek injunctive relief in any appropriate court. Each party shall bear its own legal and other costs and expenses in connection with any mediation or arbitration.

 

26.2. Payment Disputes. If you have a complaint or dispute regarding any payment to us, by us, or under these Terms, you are first required to submit details of the Payment Dispute to us via our Support Service and we will use commercially reasonable efforts to respond as quickly as possible. Both you and Gyan Money hereby agree to cooperate in good faith with each other to amicably resolve the Payment Dispute.

 

27. General.

Gyan Money reserves the right to discontinue or modify any aspect of the App/Site at any time. The App/Site Terms and the relationship between you and Gyan Money shall be governed by and construed in accordance with the laws,

without regard to its principles of conflict of laws. You hereby waive the right to a jury trial or to participate in a class action.

If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and a party’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. YOU AGREE THAT ANY CAUSE OF ACTION THAT YOU MAY HAVE ARISING OUT OF OR RELATED TO THE App/Site MUST COMMENCE WITHIN SEVEN DAYS AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
